Expropriation without compensationFact or fiction?
Until such time as the Constitutional Review Committee has come up with the proposed wording of any amendment to section 25 of the Constitution, it is not only dangerous, but also fruitless to speculate on this issue.
For the moment section 25 of the Constitution prohibits arbitrary deprivation of property. Property may be expropriated only in terms of a law of general application for a public purpose or in the public interest and subject to compensation, the amount of which and the time and the manner of payment of which have either been agreed to by those affected, or decided or approved by a Court. (See section 25(2) of the Constitution).
